This Privacy Policy explains how Clerkzo (“Clerkzo,” “we,” “us,” or “our”) collects, uses, and protects personal data when you use our AI chat widget service, our website, and the chat widget you embed on your own site (together, the “Service”).
Clerkzo serves two groups of people, and this policy covers both:
- Customers, the businesses and individuals who sign up for a Clerkzo account and deploy the widget.
- End users, the visitors who interact with the chat widget on a Customer's website.
1. Who is responsible for your data
For account, billing, and website data, Clerkzo acts as the data controller.
For conversations and lead details captured through the widget on a Customer's website, the Customer is the controller and Clerkzo acts as a data processor, handling that data on the Customer's behalf and under their instructions. If you are an end user with a question about your data, please contact the business whose website you were chatting on.
2. Data we collect
From Customers
- Account data: name, email address, and password credentials used to create and secure your account.
- Billing data: your plan, subscription status, and billing identifiers. Card details are handled directly by our payment processor, Stripe, Clerkzo never stores full card numbers.
- Agent configuration: the website URLs, uploaded files, and text you provide to train your AI agent, along with the settings and instructions you configure.
From End users
- Conversation content: the messages exchanged with the AI agent during a chat session.
- Lead details: information a visitor chooses to provide, such as name, email, phone number, and a description of what they need, the booking basics.
- Technical data: limited metadata such as timestamps and the page a conversation started on, used to operate and secure the Service.
3. How we use data
- To provide, operate, and maintain the Service.
- To generate AI responses trained on the content each Customer provides.
- To capture and deliver leads to the relevant Customer.
- To process subscriptions and payments.
- To secure the Service, prevent abuse, and comply with the law.
- To communicate with Customers about their account, updates, and support requests.
We do not sell personal data, and we do not use the contents of end-user conversations to train models for other Customers.
4. AI processing and subprocessors
To generate responses, conversation content is sent to third-party AI model providers that process it solely to return a reply. We also rely on infrastructure and service providers, including hosting, database, and payment providers such as Stripe, who process data on our behalf under contractual safeguards. We only share what is necessary for each provider to perform its function.
5. Data retention
We keep Customer account data for as long as the account is active. Conversation history and leads are retained so Customers can review them in their dashboard, and are deleted when a Customer deletes them or closes their account, subject to any legal retention obligations. You may request deletion at any time as described below.
6. Security
Data is encrypted in transit and at rest. Access is restricted to what is needed to operate the Service. No system can be guaranteed perfectly secure, but we take reasonable technical and organizational measures to protect personal data against loss, misuse, and unauthorized access.
7. Your rights
Depending on where you live, you may have the right to access, correct, export, or delete your personal data, and to object to or restrict certain processing. Customers can manage much of their data directly in the dashboard. To make a request, contact us using the details below. End users should direct requests to the business whose website they used.
8. Cookies
Our marketing site and dashboard use essential cookies to keep you signed in and to operate the Service. The embedded widget uses only the storage needed to maintain a conversation session.
9. Children
The Service is not directed to children under 16, and we do not knowingly collect their personal data.
10. Changes to this policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify Customers.
